1. Acceptance of Terms

Welcome to NyxArcana, operated by NyxArcana ("we", "us", "our"). By downloading, installing, accessing, or using NyxArcana application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and NyxArcana governing your use of the App and all related services.

2. Account Registration

To access certain features of the App, you must create an account. When registering, you agree to:

Provide a valid email address and accurate registration information.
Keep your account credentials secure and confidential.
Accept responsibility for all activity that occurs under your account.
Notify us promptly of any unauthorized use of your account.

Age Requirement: You must be at least 13 years of age to create an account and use the App. By registering, you confirm that you meet this age requirement. If you are under 18, you represent that a parent or legal guardian has reviewed and agrees to these Terms on your behalf.

3. Entertainment Disclaimer

All tarot readings, interpretations, and AI-generated content provided by the App are for entertainment and personal reflection purposes only.

They do not constitute medical, financial, legal, psychological, or professional advice of any kind. You should not make important life decisions based solely on tarot readings.

If you are experiencing a medical, psychological, legal, or financial issue, please consult a qualified professional. The App is not a substitute for professional guidance.

4. AI-Generated Content

Some features of the App use artificial intelligence (powered by OpenAI) to generate tarot interpretations, reading summaries, and other content. By using these features, you acknowledge and agree that:

AI-generated outputs may be inaccurate, incomplete, or inappropriate.
We make no guarantees about the accuracy, reliability, or suitability of AI-generated content.
AI-generated content should not be relied upon as factual, professional, or authoritative.
You use AI-generated features at your own discretion and risk.

We continually work to improve the quality of AI-generated content but cannot guarantee perfection. If you encounter content that is offensive or harmful, please contact us.

5. Subscription Terms & Auto-Renewal

The App offers the following subscription tiers:

Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You will be charged the applicable subscription fee at the start of each new billing period.

All payments are processed securely by Stripe. By subscribing, you authorize Stripe to charge your selected payment method on a recurring basis according to your chosen billing cycle (monthly or yearly).

You may cancel your subscription at any time through the Stripe Customer Portal, accessible from within the App. Cancellation will take effect at the end of your current billing period, and you will retain access to your subscription features until that date.

6. Refund Policy

No refunds are provided for partial billing periods. When you cancel a subscription:

Your cancellation takes effect at the end of your current billing period.
You will continue to have access to paid features until the end of the period you have already paid for.
No prorated or partial refunds will be issued for the remaining time in a billing period.

If you believe you have been charged in error, please contact us at support@nyxarcana.com and we will review your case.

7. Reader/Querent Sessions

The App may offer live reading sessions between a reader and a querent (the person receiving a reading). By participating in a live reading session, you acknowledge and consent to the following:

Reading data, including card positions, interpretations, and session details, will be shared with the other party in the session.
You are responsible for the content you communicate during sessions.
Sessions are subject to the entertainment disclaimer outlined in Section 3.
You agree not to use sessions to harass, deceive, or cause harm to other users.

We reserve the right to monitor, moderate, or terminate sessions that violate these Terms.

8. Intellectual Property

Our Content: All content within the App, including but not limited to text, graphics, card artwork, user interface design, logos, and software code, is the property of NyxArcana and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without express written permission.

Your Content: Any reading data, notes, journal entries, and other content you create within the App remains your property. By using the App, you grant us a limited license to store and process your content solely for the purpose of providing the App's services to you.

You retain the right to export and delete your personal data at any time through the App's backup features.

9. Limitation of Liability

The App is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied.

To the fullest extent permitted by law:

We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
We are not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App.
We are not liable for any decisions or actions you take based on tarot readings, interpretations, or AI-generated content provided by the App.
Our total aggregate liability to you for any claims arising from these Terms or your use of the App shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim.

10. Termination

We reserve the right to suspend or terminate your account and access to the App at our sole discretion, with or without notice, for conduct that we determine:

Violates these Terms of Service.
Is harmful to other users, third parties, or the business interests of NyxArcana.
Involves fraudulent, abusive, or illegal activity.

Upon termination, your right to use the App ceases immediately. We may, but are not obligated to, provide you with an opportunity to retrieve your data prior to termination. Any fees already paid are non-refundable upon termination for cause.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the operator resides, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of that jurisdiction.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

12. Changes to Terms

We may update or modify these Terms from time to time. When we make changes, we will update the "Last updated" date at the top of this page. We may also notify you of significant changes through the App or via email.

Your continued use of the App after any changes to these Terms constitutes your acceptance of the updated Terms. If you do not agree with the updated Terms, you should stop using the App and, if applicable, cancel your subscription.

We encourage you to review these Terms periodically to stay informed about our terms and conditions.
